These Terms of Use ("Terms") govern your use of the Cotinerary mobile apps, the website at getcotinerary.com, the Cotinerary API and MCP server, and related services (together, the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 13 years old, or the minimum age required in your country, to use the Service. You sign in with a third-party account such as Apple or Google, and you are responsible for keeping that account secure and for all activity under your Cotinerary account.

2. Your content

You keep ownership of the trips, notes, files and emails you add to the Service ("Your Content"). You grant Cotinerary a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce and display Your Content only as needed to operate, secure and improve the Service, including sharing it with the trip members you invite and processing it with the service providers described in our Privacy Policy.

You are responsible for Your Content and confirm you have the right to add it, including any personal information about other travelers.

3. Shared trips

Trip owners control who can access a trip and in what role. Editors can change a trip's content and viewers can see it. Anything you add to a shared trip is visible to its members. If a trip owner deletes a trip or their account, the trip is deleted for all members.

4. Automated features and third-party information

Cotinerary uses automated systems, including AI models, to extract booking details from emails you forward, and relies on third parties for flight status, maps, places and weather. These features may be incomplete, delayed or inaccurate. Always confirm times, gates, reservations and travel requirements with your airline, hotel or other provider. Cotinerary is not a travel agent, does not make bookings and is not responsible for missed connections, reservations or other losses resulting from reliance on information in the Service.

5. API tokens and AI assistants

You may create personal API tokens to connect AI assistants or other tools to your account. Treat tokens like passwords. Actions taken with your tokens are treated as actions taken by you, and you are responsible for the third-party tools you connect and for their use of your data. We may limit, suspend or revoke API access to protect the Service.

6. Acceptable use

You agree not to:

break the law or infringe anyone's rights using the Service;
upload malware, spam or content you do not have the right to share;
attempt to access accounts, trips or data that are not yours;
interfere with, overload or reverse engineer the Service, except where the law allows;
scrape the Service or use automated access other than through the documented API within its limits;
resell or commercially exploit the Service without our permission.

7. Our service

The Service, including its software, design and trademarks, belongs to Cotinerary and its licensors. We grant you a personal, non-transferable, revocable license to use the apps for your own travel planning. We may change, add or remove features, and we may suspend or end access to the Service if you violate these Terms or if needed to protect users or the Service.

8. App stores

If you download the app from the Apple App Store or Google Play, you also agree to that store's terms. Apple and Google are not parties to these Terms and are not responsible for the app or its support. Where Apple's terms require it, Apple and its subsidiaries are third-party beneficiaries of these Terms.

9. Termination

You can stop using the Service and delete your account at any time from the app. Sections that by their nature should survive termination, including sections 2, 4 and 10 through 12, survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COTINERARY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, TRAVEL ARRANGEMENTS OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnity and governing law

You will indemnify Cotinerary against claims arising from Your Content or your violation of these Terms, to the extent permitted by law. These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Delaware, except where the law of your country of residence requires otherwise.

13. Changes

We may update these Terms. We will post the new version here and update the date above, and notify you in the app for material changes. Continuing to use the Service after changes take effect means you accept them.
